Guide for foreign buyers
The Mexican Fideicomiso: Your Secure Guide to Buying Beach Property
If you want to buy a home, condominium or land on Mexico's coast as a foreigner, a bank trust may be the applicable structure. This guide provides general information; review your case with the notary and legal team for your transaction.
How does it work?
In Mexico's restricted zone, an authorized Mexican bank may act as trustee and the foreign buyer as beneficiary. The agreement defines rights of use, enjoyment, sale, lease and successor beneficiaries.
Who participates?
The seller, trustee bank and buyer named as beneficiary participate. The notary, legal advisers and relevant authorities take part as the transaction requires.
What can the beneficiary do?
The beneficiary may exercise the rights agreed in the trust, normally including use, enjoyment, improvement, sale, lease and designation of successors, subject to legal and contractual requirements.
What should I review?
Review the term, bank fees, beneficiary rights, substitution rules, legal property description, title, liens and closing conditions.
General information, not legal advice. Consult a notary and professionals for your transaction.
